Since the mid-1990s most EU Member States have established a national forensic DNA database. These mass repositories of DNA profiles enable the police to identify DNA stains which are found at crime scenes and are invaluable in criminal investigation. Governments have always brushed aside privacy objections by stressing that the stored DNA profiles do not contain sensitive genetic information on the included individuals and that they reside under the statutory privacy protection regulations. However, it has been generally overlooked that the (...) police also store the DNA samples from which the DNA profiles are derived. Although these DNA samples are actually a potential source of genetic information, they have so far scarcely been the subject of discussion. In this article we will show that both European and national regulations offer inadequate protection to completely prevent function creep, that is, the use of these forensic DNA samples for purposes beyond those envisaged at the time of collection. In debates about the nature of scientific explanation, one theme repeatedly arises: that explanation is about providing understanding. However, the concept of understanding has only recently been explored in any depth, and this paper attempts to introduce a useful concept of understanding to that literature and explore it. Understanding is a higher level cognition, the recognition of connections between various pieces of knowledge. This conception can be brought to bear on the conceptual issues that have thus far been unclear in (...) the literature. Though this notion of understanding is broad, explaining various concepts of explanation, it is robust enough to underwrite an objective and useful notion of explanation. (shrink)

This research presents the development of a measure of religiosity that includes social intrinsic religiosity as distinct from extrinsic religiosity and from the typical conceptualization of intrinsic religiosity as an individual orientation. Study 1 developed the measure using exploratory and confirmatory factor analysis; the results confirmed two intrinsic identity factors and two extrinsic benefit factors. Correlations with previously established religiosity measures demonstrate the scales construct validity and that social intrinsic religiosity is independent from extrinsic religiosity. In Study 2, differential responding (...) by Christian and Jewish participants was consistent with these religions’ reputed cultural-theological approaches and confirmed the independence of social intrinsic religiosity. Furthermore, social intrinsic religiosity was positively correlated with prejudice towards value-violating outgroups, as would be expected from an intrinsic religiosity. These results unconfound social and extrinsic religiosity and provide empirical evidence that intrinsic religiosity can be socially as well as individually oriented. (shrink)

We study whether it is possible to generalise Seidenfeld et al.’s representation result for coherent choice functions in terms of sets of probability/utility pairs when we let go of Archimedeanity. We show that the convexity property is necessary but not sufficient for a choice function to be an infimum of a class of lexicographic ones. For the special case of two-dimensional option spaces, we determine the necessary and sufficient conditions by weakening the Archimedean axiom.

We introduce an independence notion for choice functions, which we call ‘epistemic independence’ following the work by De Cooman et al. [17] for lower previsions, and study it in a multivariate setting. This work is a continuation of earlier work of one of the authors [29], and our results build on the characterization of choice functions in terms of sets of binary preferences recently established by De Bock and De Cooman [11]. We obtain the many-to-one independent natural extension in this (...) framework. Given the generality of choice functions, our expression for the independent natural extension is the most general one we are aware of, and we show how it implies the independent natural extension for sets of desirable gambles, and therefore also for less expressive imprecise-probabilistic models. Once this is in place, we compare this concept of epistemic independence to another independence concept for choice functions proposed by Seidenfeld [28], which De Bock and De Cooman [2] have called S-independence. This paper turns to Hannah Arendt’s brief, poignant remarks about the advent of a biotechnological revolution as a starting point for a renewed reflection on her concept of natality. By expanding on Arendt's significant, but often overlooked, reference to the work of the German anthropologist Arnold Gehlen, it will be argued that that natality is a concept that subverts any rigid opposition between zoe and bios, biological birth and politico-linguistic birth. Consequently, it will be shown that Jürgen Habermas and Michael (...) Sandel are mistaken to appeal to the concept of natality in their arguments against genetic enhancement. (shrink)

We study the representation of sets of desirable gambles by sets of probability mass functions. Sets of desirable gambles are a very general uncertainty model, that may be non-Archimedean, and therefore not representable by a set of probability mass functions. Recently, Cozman (2018) has shown that imposing the additional requirement of even convexity on sets of desirable gambles guarantees that they are representable by a set of probability mass functions. Already more that 20 years earlier, Seidenfeld et al. (1995) gave (...) an axiomatisation of binary preferences—on horse lotteries, rather than on gambles—that also leads to a unique representation in terms of sets of probability mass functions. To reach this goal, they use two devices, which we will call ‘SSK–Archimedeanity’ and ‘SSK–extension’. In this paper, we will make the arguments of Seidenfeld et al. (1995) explicit in the language of gambles, and show how their ideas imply even convexity and allow for conservative reasoning with evenly convex sets of desirable gambles, by deriving an equivalence between the SSK–Archimedean natural extension, the SSK–extension, and the evenly convex natural extension. Although DNA profiling has been an important forensic research technique since the late 1980s, for a long time, it had not captured much attention from either academics or the public so far.In recent years, this neglect seems to have ended. Not only has wide-spread media coverage of events such as 9/11 and the 2004 tsunami brought about widespread knowledge of the usefulness of forensic DNA identification, the development of large databases containing DNA profiles of both suspected and convicted criminals has (...) in the last few years also triggered a discussion on the intrusiveness of these measures into a number of civil rights.Indeed, although the increasing use of DNA based techniques in the criminal justice system promises to offer some great benefits for a society that is permeated with risk-aversion, at the same time it also gives rise to some worrying ethical and social consequences.In this article, we confine ourselves to an analysis of the practice of DNA sample retention by government agencies that use these samples to derive digital storable DNA profiles. While this practice seems unnecessary for the purpose of criminal investigation, it carries some severe risks for genetic privacy rights which have hardly been explored so far. (shrink)

I wonder why women philosophers, once recognized, too often seem to drop from the intellectual radar screen or, at least, to drop mainly to the land of footnotes and bibliographies. I consider one distinguished moral philosopher, Elizabeth Lane Beardsley, both to highlight her philosophical contributions and as a case study that suggests more widespread problems in recognizing t5he work of female philosophers and ensuring their rightful place in our professional dialogue. I consider sociological and professional factors which might partially explain (...) why work by women philosophers has not always received the attention in the professional dialogue it seems to deserve. I conclude with some modest suggestions about the efforts that we can make to address these problems, including the organization of readings for our own courses, the sources consulted for our own research and writing, and the preservation of rec rods of meetings and other public gatherings that recognize women philosophers. I consider why women philosophers, once identified and given recognition, too often seem to drop from the intellectual radar screen or, at least, to drop mainly to the land of footnotes and bibliographies. Are they disappearing any more than men of comparable stature from their generation? Is there anything we can do about this? Can we do more than excavate and recognize women in philosophy? What can we do to continue and enhance their presence in the historic dialogue of philosophy?

Surprise – these much-publicized rules are not the least bit reassuring to people who specialize in the study of ethics. While attention to ethics is certainly welcome, these ethical codes provide a too-easy cop-out, a way to neatly dispose of attention to nagging and pervasive problems. The typical professional code is little more than a checklist of rules that enables professionals of any stripe to give lip service to ethical behavior without engaging in continuing dialogue on ethical dilemmas. Neatly packaged (...) commandments short-circuit development of the reasoning tools to work through ethical challenges meaningfully and with long-lasting impact on the actual behavior in any field. Dance is an elusive art form, existing in the moment of performance. Its transience poses special obstacles to analysis by scholars. Program notes, reports by critics, personal memories, and still photographs provide secondary sources limited in their potential for sustained analysis and study of actual dances.

From the mid-thirties onwards, Martin Heidegger occasionally speculated about the future possibility of artificially producing human beings. What is at stake in biotechnology, Heidegger claims, is the imminent possibility of the destruction of the human essence. It is unclear, however, how Heidegger can substantiate such a claim given that he consistently denounced attempts to define human Dasein as a living being to which a higher capacity such as reason or language is added. This paper will argue that, in this sense, (...) Heidegger took the radical challenge of biotechnology both too seriously and not seriously enough. Too seriously, because it is unclear why he would fear the annihilation of Dasein’s essence if he is convinced that this essence is not related to man’s biological equipment in the first place. Not seriously enough, because Heidegger at the same time remained convinced that even the most intrusive interventions in the human body will not be able to disrupt Dasein’s ontological essence. This article critically surveys the current bioethical and politico-philosophical debate about the ethical permissibility of a so-called ‘liberal eugenics’ and argues that neither the liberal argument for nor the liberal argument against human genetic enhancement is internally consistent as, ultimately, each ends up violating the very liberal principles it nonetheless pretends to defend. In particular, it will be shown that while the argument against a new eugenics necessarily entails a preemptive dehumanization of any potential enhanced form of life, the argument (...) for it threatens to reduce any non-enhanced form of life to a “wrongful life” or a life not worth living. It will therefore be concluded that the specific stakes of this contentious issue cannot be grasped within a liberal conceptual framework. (shrink)

Reno v. ACLU , the 1997 landmark decision by the United States Supreme Court providing sweeping protection to speech on the Internet, is usually discussed in terms of familiar First Amendment issues. Little noticed in the decision is the significance of the ontological assumptions of the justices in their first visit to cyberspace. I analyze the apparent awareness of the Supreme Court of ontological issues and problems with their approaches. I also argue that their current ontological assumptions have left open (...) the door to future suppression of free speech as the technology progresses. Ontology is significant because zoning in the physical world has long been recognized as a way to segregate "adult" entertainment from minors. So far, at least, the justices seem to agree that such zoning is not possible in cyberspace, and therefore that adult zones for certain forms of expression are not possible. But this conclusion is far from settled. The degree of free speech on the Internet in the future will depend on whether or not our ontological understanding of cyberspace supports such zoning or renders it incoherent or impossible. For many citizens, news media are the most important source of information about relevant political topics and actors. As a consequence, it is crucial to investigate who gains media coverage and why. Leaning on two classic news sourcing criteria, suitability and availability, we claim that issue owners can be seen as good news sources. By combining a content analysis of television news with data collected through a journalist survey, we investigate whether issue ownership is a determinant of political parties’ news (...) coverage. Results confirm that issue ownership is a predictor of parties’ news coverage, even when controlling for ministerial competences. (shrink)

The U.S. Supreme Court recently held that a parody by the rap group 2 Live Crew of Ray Orbison's song "Oh, Pretty Woman" was "fair use" and thus did not infringe the copyright. Although the court insisted that it was not evaluating the quality of the parody, I argue that it does in fact make several aesthetic evaluations and sometimes even seems to praise the content of the parody. I first consider the stated reasons for the claimed refusal of the (...) court to evaluate aesthetic quality. Second, I examine the evaluations which the court in fact does make, at least some of which are clearly aesthetic evaluations. I then argue that aesthetic value judgments are both necessary and possible for determinations of "fair use" for such works as the "Pretty Woman" parody. (shrink)

Hannah Arendt calls “natality,” the fact that human beings enter the world through birth, the centralcategory of political thought. But how can she assert that being born conditions one to act freely if shealso seems to maintain that is through labor, not action, that human beings deal with biologicallyconditioned processes?
